Have Patients Filed Claims Against Your Doctor?

by

Choosing a doctor in today’s wake of medical malpractice claims can be daunting. You want to be sure you are choosing a medical provider who you can develop a lasting relationship with and not have to worry about mistakes or negligence. Knowing whether or not patients have filed claim against a medical professional can help in your decision-making process. Here’s how to find out.

1. State Medical Board

Every state in the country has a medical board that licenses medical professionals in their state. These are also the people that keep track of medical malpractice claims. Almost every state has a website for its medical board that is free for the public to use. A simple search of such a site will let you know if a doctor you are considering has had any disciplinary action taken against them or has been to court for medical malpractice.

2. Court Records

If a medical professional in your locality has been sued for medical malpractice, there will be a record of it at the County Clerk’s office. A check of their website or a quick phone call will tell you if your doctor has been a defendant in any law suits.

3. Search Engine

Use your favorite search engine to your advantage. Search for the doctor’s name and use keywords like “malpractice claim”, “complaints” or “problems.” You will also want to include the state where the doctor practices in your search. For example, type “Jane Doe, MD + complaints + New York” to search for your doctor. Replace “complaints” with different keywords to be sure you aren’t missing anything.

Let’s say that you discover that your doctor has been sued. Now what? Don’t let the knowledge that a doctor has been involved in a claim automatically remove them from your list. Get the facts first. Some lawsuits have nothing to do with medical malpractice at all. If you do find out, however, that the lawsuit has been based upon negligence or error, you know that your search should continue.
