A medical malpractice case involving the premature delivery of a baby girl has been settled after 11 years in a jury trial in a Bucks County Court.
According to court documents, Denise and Louis Mamie named Dr. Aaron Hasiuk, who is an employee of Temple Physicians, Inc., as responsible for events that led to the premature birth of their daughter Jessica on July 23, 2002 and the related complications.
The Mamies assert that Dr. Hasiuk performed an internal exam without permission on Denise Mamie by inserting a speculum into her vagina, which ultimately led to the need for a cesarean section delivery.
The plaintiff argued that because Denise Mamie had a dangerous medical condition during her pregnancy, a cesarean was required in order to keep mother and baby safe.
Denise Mamie was admitted to Lower Bucks Hospital in Bristol Township on July 23, 2002 after complaining of bleeding. After Dr. Hasiuk performed the internal exam, the plaintiff said Mamie had a full placenta previa, a condition where the placenta lies below the fetus that can prove to be both dangerous to mother and infant.
Hasiuk determined that the situation called for an immediate cesarean delivery and ordered Mamie to the labor and delivery room. Jessica was delivered successfully by cesarean section.
Jessica was born 13 weeks prematurely at 27 weeks gestation. Because of her early delivery, the infant was required to have a tracheal reconstruction surgery in 2005 and had a ventriculoperitoneal shunt to treat hydrocephalus, a condition that occurs when excess fluid lies on the brain and needs to be drained to relieve dangerous pressure from the area.
Attorneys for the plaintiffs and for the defense were about to make closing arguments in the case when a settlement for an undisclosed amount was announced.
